Unangemessene Behandlung wie Unter- oder Überversorgung zu erkennen und zu vermeiden, stellt Ärztinnen/Ärzte und Pflegende am Krankenbett vor schwierige Entscheidungen. Hier ist die Entwicklung von praxistauglichen Orientierungshilfen angezeigt, die wissenschaftlichen Kriterien genügen und nicht allein auf Konsens beruhen. Die vorliegende Arbeit versucht, zentrale Normen zur Vermeidung von Über- und Unterversorgung zu formulieren und theoretisch zu fundieren. „Rechtsgefühl“ kann das individuelle Gerechtigkeitsempfinden, das Judiz der Richterin im Entscheidungsfindungsprozess, das emotionale Aufbäumen der unterlegenen Partei nach der Entscheidung, eine kollektive Rechtsüberzeugung bezeichnen. Verweise auf das „Rechtsgefühl“ werden oft genutzt, um Rechtssysteme oder einzelne Rechtsakte von innen oder von außen zu legitimieren oder zu delegitimieren. IN THE winter and spring of 1031,1 was invited to give a series of ten lectures at Harvard University. The subject chosen was the Philosophy of Art; the lectures are the origin of the present volume. The Lectureship was founded in memory of William James and I esteem it a great honor to have this book associated even indirectly with his distinguished name. It is a pleasure, also, te recall, in connection with the lectures, the unvarying kindness and hospitality of (...) my colleagues in the department of philosophy at Harvard. Climate change can be interpreted as a unique case of historical injustice involving issues of both intergenerational and global justice. We split the issue into two separate questions. First, how should emission rights be distributed? Second, who should come up for the costs of coping with climate change? We regard the first question as being an issue of pure distributive justice and argue on prioritarian grounds that the developing world should receive higher per capita emission rights than the developed world. (...) This is justified by the fact that the latter already owns a larger share of benefits associated with emission generating activities because of its past record of industrialisation. The second question appears to be an issue of compensatory justice. After defining what we mean by compensation, we show that different kinds of compensatory principles run into problems when used to justify payments by historical emitters of the North to people suffering from climate change in the South. As an alternative, we propose to view payments from wealthy countries for adaptation to climate change in vulnerable countries rather as a measure based on concerns of global distributive justice. Ulrich Meyer defends a novel theory about the nature of time, and argues against the consensus view that time and space are fundamentally alike. He presents the first comprehensive defense of a 'modal' account, which emphasizes the similarities between times and possible worlds in modal logic, and is easily reconciled with the theory of relativity.

The report of the President's Council on Bioethics, Human Cloning and Human Dignity, addresses the central ethical, political, and policy issue in human embryonic stem cell research: the moral status of extracorporeal human embryos. The Council members were in sharp disagreement on this issue and essentially failed to adequately engage and respectfully acknowledge each others' deepest moral concerns, despite their stated commitment to do so. This essay provides a detailed critique of the two extreme views on the Council (i.e., embryos (...) have full moral status or they have none at all) and then gives theoretical grounding for our judgment about the intermediate moral status of embryos. It also supplies an account of how to address profound moral disagreements in the public arena, especially by way of constructing a middle ground that deliberately pays sincere respect to the views of those with whom it has deep disagreements. Despite ongoing feminist debates about the past, present and future of feminism, the multidimensionality of time in activist work has largely remained under-examined. This article develops the partial timeframes of trajectories, encounters and timings to explore the practices of women organizing in Czech NGOs after 1989. Empirically the study draws on individual and group interviews conducted with NGO activists in 2003/2004 and 2009/2010 as well as organizational websites. The article argues that a timescape perspective provides a useful heuristic lens for (...) tracing trajectories of organizing shaped by different funding mechanisms; activist encounters that open up social and political alternatives of acting and being; and the effects of timing activist engagements with the lifetimes of activists. The conclusion reflects on the implications of an investigation through time for reconfiguring pervasive deficit accounts of NGO-based activism and its futures. (shrink)

This article discusses relations among the multiple levels of analysis present in macro-sociological explanation—i.e., relations of individual, structural, and institutional processes. It also criticizes the doctrinal insistence upon single-level individualistic explanation found in some prominent contemporary sociological theory. For illustrative material the article returns to intellectual uses of Weber's "Protestant Ethic thesis," showing how an artificial version has been employed as a kind of proof text for the alleged scientific necessity of individualist explanation. Our alternative exposition renders the discussion of (...) Protestantism and capitalism in an explicitly multilevel way, distinguishing possible individual-level, social-organizational, and institutional linkages. The causal processes involved are distinct ones, with the more structural and institutional forms neither captured nor attainable by individual-level thinking. We argue more generally that "methodological individualisms" confuse issues of explanation with issues about microfoundations. This persistent intellectual conflation may be rooted in the broader folk models of liberal individualism. (shrink)

To deal with the upcoming challenges and complexity of the nursing profession, it is deemed important to reflect on our current organization of care. However, before starting to rethink the organization of nursing care, an overview of important elements concerning nursing care organization, more specifically nursing models, is necessary. The aim of this study was to conduct a mapping review, accompanied by an evidence map to map the existing literature, to map the field of knowledge on a meta‐level and to (...) identify current research gaps concerning nursing models in a hospital setting. Next to nursing models, two other organizational correlates seem to be of importance when looking at the organization of nursing care: nurse staffing and skill mix. Although it seems that in recent research, the theoretical focus on the organization of nursing care has been left behind, the increasingly complex healthcare environment might gain from the use of nursing theory, or in this case, care delivery models. As almost no fundamental studies have been done toward the combination of care delivery models, nurse staffing, and skill mix, those elements should be taken into account to fully capture the organization of nursing care in future research. A 'Kripke-style' semantics is given for combinatory logic using frames with a ternary accessibility relation, much as in the Tourley-Meyer semantics for relevance logic. We prove by algebraic means a completeness theorem for combinatory logic, by proving a representation theorem for 'combinatory posets.' A philosophical interpretation is given of the models, showing that an element of a combinatory poset can be understood simultaneously as a set of states and as a set of actions on states. This double interpretation allows (...) for one such element to be applied to another . Application turns out to be modeled the same way as 'fusion' in relevance logic.We also introduce 'dual combinators' that apply from the right. We then explore relationships to some well-known substructural logics, showing that each can be embedded into the structurally free. non-associative Lambek calculus, with the embedding taking a theorem ω to a statement of the form Γ ⊨ ω, where Γ is some fusion of the combinators needed to justify the structural assumptions of the given substructural logic. This builds on earlier ideas from Belnap and Meyer about a Gentzen system wherein structural rules are replaced with rules for introducing combinators. Since 2011, the research community had waited with bated breath as regulators contemplated for the first time bringing secondary research with nonidentifiable biospecimens under the Common Rule and dramatically tightening the criteria for waiving consent to biospecimen research. After considerable pushback from both researchers and patients and amid rumors of intractable disagreement among Common Rule agencies, the Final Rule published on the last day of President Obama's administration left out these troubling changes, and there was a collective sigh of relief. Relief is appropriate, but celebration premature: researchers have little reason to avail themselves of the new broad consent option offered in the Final Rule, and the question of whether biospecimens ought to be treated as inherently identifiable has merely been postponed. Alliances and other forms of cooperation between firms often promise great benefits, for example, by the exchange of knowledge or co-specialization of resources. At the same time, the necessary actions to realize these benefits can augment vulnerability to opportunistic behaviour of partners. In addition to formal contracts to mitigate the resulting behavioural uncertainties, often, mechanisms, such as reputation or ethical values, are suggested as important supplements. However, when it comes to assessment of a specific cooperation opportunity, it is difficult to (...) account systematically for the economic consequences of these 'softer factors'. Therefore, this paper aims to surpass mere financial analysis of chance and risk and to integrate systematically both reputation and ethical values into an economic assessment of cooperative relationships. For this purpose, we develop a theoretical framework that is based on a simple-decision model to account for reputation and ethical values of potential partners as drivers of behavioural uncertainty reduction. We also discuss how this framework can be used to assess cooperative relationships and illustrate these ideas with reference to the inter-organizational accounting practices of a large drugstore chain and its suppliers. The Logic R4 is obtained by adding the axiom □ → to the modal relevant logic NR. We produce a model theory for this logic and show completeness. We also show that there is a natural embedding of a Kripke model for S4 in each R4 model structure.

This paper discusses the relation between the minimal positive relevant logic B and intersection and union type theories. There is a marvelous coincidence between these very differently motivated research areas. First, we show a perfect fit between the Intersection Type Discipline ITD and the tweaking BT of B, which saves implication and conjunction but drops disjunction . The filter models of the -calculus (and its intimate partner Combinatory Logic CL) of the first author and her coauthors then become theory models (...) of these calculi. (The logician's "theory" is the algebraist's "filter".) The coincidence extends to a dual interpretation of key particles—the subtype translates to provable , type intersection to conjunction , function space to implication, and whole domain to the (trivially added but trivial) truth T. This satisfying ointment contains a fly. For it is right, proper, and to be expected that type union should correspond to the logical disjunction of B. But the simulation of functional application by a fusion (or modus ponens product) operation on theories leaves the key Bubbling lemma of work on ITD unprovable for the -prime theories now appropriate for the modeling. The focus of the present paper lies in an appeal to Harrop theories which are (a) prime and (b) closed under fusion. A version of the Bubbling lemma is then proved for Harrop theories, which accordingly furnish a model of and CL. (shrink)

We present a solution to the paradox of free choice permission by introducing strong and weak permission in a deontic logic of action. It is shown how counterintuitive consequences of strong permission can be avoided by limiting the contexts in which an action can be performed. This is done by introducing the only operator, which allows us to say that only is performed (and nothing else), and by introducing contextual interpretation of action terms.

For centuries, the processes of social differentiation associated with Modernity have often been thought to intensify the need for site-specific forms of role training and knowledge production, threatening the university’s survival either through fragmentation or through failure to adapt. Other lines of argument emphasize the extent to which the Modern system creates and relies on an integrated knowledge system, but most of the literature stresses functional differentiation and putative threats to the university. And yet over this period the university has (...) flourished. In our view, this seeming paradox is explained by the fact that modern society rests as much on universalistic cosmological bases as it does on differentiation. The university expands over recent centuries because – as it has from its religious origins – it casts cultural and human materials in universalistic terms. Our view helps explain empirical phenomena that confound standard accounts: the university’s extraordinary expansion and global diffusion, its curricular and structural isomorphism, and its relatively unified structure. All of this holds increasingly true after World War II, as national state societies made up of citizens are increasingly embedded in a world society constituted of empowered individuals. The redefinition of society in global and individual terms reduces nationally bounded models of nature and culture, extends the pool of university beneficiaries and investigators, and empowers the human persons who are understood to root it all. The changes intensify universalization and the university’s rate of worldwide growth. For the university’s knowledge and “knowers,” and for the pedagogy that joins them together, the implications are many. The emerging societal context intensifies longstanding processes of cultural rationalization and ontological elaboration, yielding great expansions in what can and should be known, and in who can and should know. These changes in turn alter the menu of approved techniques for joining knowledge and knower as one. The “knowledge society” that results is distinguished by the extraordinary degree to which the university is linked to society. But it is also distinguished by the degree to which society is organized around the university’s abstracted and universalized understandings of the world and its degree-certified graduates. (shrink)

For thousands of years it has existed and has been growing older; but in the earlier part of this period it cannot boast of any continuous progress toward a riper and richer development. In the fourth century before our era that giant thinker, Aristotle, built it up into an edifice comparing very favorably with any other science of that time. But this edifice stood without undergoing any noteworthy changes or (...) extensions, well into the eighteenth or even the nineteenth century. Only in recent times do we find an advance, at first slow but later increasing in rapidity, in the development of psychology. The general causes which checked the progress of this science and thus made it fall behind the others can readily be stated:— "The boundaries of the Soul you cannot find, though you pace off all its streets, so deep a foundation has it," runs a sentence of Heraclitus, and it hits the truth more fully than its author could ever have expected. The structures and functions of our mental life present the greatest difficulties to scientific investigation, greater even than those presented by the phenomena, in many respects{4} similar, of the bodily life of the higher organisms. These structures and processes change so unceasingly, are so fleeting, so enormously complex, and dependent on so many factors hidden yet undoubtedly influential, that it is difficult even to seize upon them and describe their true substance, still more difficult to gain an insight into their causal connections and to understand their significance. Commodity chain analysis (Bair and Ramsay, 2003 Multinational Companies and Global Human Resource Strategies) is used to explore where economic pressure (from consumers) or socio-political pressure (from governments and NGOs) can be applied to reduce worker exploitation. Six paths are illustrated with examples of successful and unsuccessful application of pressure. Three conclusions are reached :Economic pressure on companies and brand owners is more likely to lead to improved workplace conditions than socio-political pressure; Brand owners are more likely to implement improved (...) workplace conditions than retailers; and Retailers who are under extreme consumer price pressure will resist improving workplace conditions. The axiom of recovery, while capturing a central intuition regarding belief change, has been the source of much controversy. We argue briefly against putative counterexamples to the axiom—while agreeing that some of their insight deserves to be preserved—and present additional recovery-like axioms in a framework that uses epistemic states, which encode preferences, as the object of revisions. This makes iterated revision possible and renders explicit the connection between iterated belief change and the axiom of recovery. We provide a representation theorem (...) that connects the semantic conditions we impose on iterated revision and our additional syntactical properties. We show interesting similarities between our framework and that of Darwiche–Pearl (Artificial Intelligence 89:1–29 1997). In particular, we show that intuitions underlying the controversial (C2) postulate are captured by the recovery axiom and our recovery-like postulates (the latter can be seen as weakenings of (C2)). We present postulates for contraction, in the same spirit as the Darwiche–Pearl postulates for revision, and provide a theorem that connects our syntactic postulates with a set of semantic conditions. Lastly, we show a connection between the contraction postulates and a generalisation of the recovery axiom. (shrink)
